Terms and Conditions

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and LizBet Drive (Pty) Ltd (“LizBet Drive”, “we”, “us”, or “our”), governing your use of our website, mobile application, and services. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, you may not use our services.

1. Eligibility and Account Registration

You must be at least 18 years old and legally capable of entering into contracts. Renters must possess a valid driver’s license issued in South Africa. To use certain features, you must register and maintain an account with accurate, up-to-date information. You are responsible for safeguarding your login credentials.

2. Scope of Services

LizBet Drive is a peer-to-peer car rental platform. We connect Hosts (vehicle owners) and Renters. We are not a rental agency and do not own or operate vehicles listed on the platform. All bookings are agreements between Host and Renter.

3. User Roles and Responsibilities

  • Hosts must ensure all listed vehicles are roadworthy, properly licensed, and accurately described.
  • Renters agree to return vehicles in the same condition and on time, and may be held liable for damages or late returns.
  • Both parties agree to communicate honestly and resolve disputes in good faith.

4. Verification

All users must complete identity verification, including uploading a government-issued ID, proof of address, and where applicable, a vehicle license disk. We may use third-party services to assist in this process.

5. Bookings and Cancellations

Renters request bookings, which must be confirmed by the Host. Either party may cancel prior to the agreed start time. Repeated cancellations or no-shows may result in account suspension. Hosts and Renters must perform pre- and post-rental vehicle inspections.

6. Payments, Fees, and Deposits

6.1. Peer Payments: LizBet Drive does not process or facilitate rental payments. All financial transactions for rentals occur directly between the Host and Renter, outside of the platform.

6.2. Platform Usage Fees: LizBet Drive may charge Hosts prepaid usage fees or offer subscription packages, which grant access to booking requests or visibility on the platform. These fees are not tied to individual bookings and are non-refundable once used.

6.3. Host-Imposed Deposits: A Host may, at their sole discretion, require a refundable deposit from the Renter prior to releasing the vehicle. The amount, terms, method of payment, and refund procedure are entirely determined by the Host.

LizBet Drive is not responsible for managing, securing, or refunding any such deposits. Renters must clarify and agree on the deposit terms with the Host directly before confirming the booking.

Any disputes related to deposits must be resolved between the involved parties. We encourage users to document vehicle condition with photos and use clear communication through the platform chat for transparency.

7. Damage, Liability and Insurance

Hosts are encouraged to maintain insurance on their vehicles. Renters are responsible for any damage not identified during pre-inspection. LizBet Drive is not liable for damages, theft, or disputes arising from transactions between users.

8. Prohibited Conduct

You may not:

  • Use the platform for illegal purposes.
  • List or rent vehicles that are stolen, defective, or unregistered.
  • Use fake identities, upload false documents, or impersonate others.
  • Harass, threaten, or defraud other users.

9. Account Suspension and Termination

We reserve the right to suspend or permanently ban users who violate these Terms, pose a risk to others, or engage in fraud. We may retain transaction records for legal compliance even after account closure.

10. Platform Availability and Modifications

We may change, suspend, or terminate access to the platform or any features without prior notice. We do not guarantee uninterrupted availability.

11. Intellectual Property

All trademarks, logos, and content on the platform are the intellectual property of LizBet Drive or its licensors. You may not copy, reproduce, or distribute our materials without permission.

12. Privacy and Data Use

Use of the platform is subject to our Privacy Policy. By using LizBet Drive, you consent to the collection and processing of your data for service delivery, verification, and legal compliance.

13. Dispute Resolution

In the event of a dispute between users, we encourage direct resolution. LizBet Drive may assist informally but does not arbitrate. For legal disputes involving us, jurisdiction will be South African courts.

14. Indemnification

You agree to indemnify and hold LizBet Drive harmless from any claims, damages, or expenses resulting from your breach of these Terms, unlawful activity, or violation of rights of others.

15. Limitation of Liability

To the fullest extent permitted by law, LizBet Drive is not liable for indirect, incidental, special, or consequential damages arising out of or related to your use of the platform.

16. Amendments

We may revise these Terms at any time. Updates will be posted with a new “Effective Date.” Continued use of the platform after such updates constitutes acceptance of the new Terms.
